Molly & Cooper website and related services are made available to you in accordance with the following Terms and Conditions (“T&C”). Molly & Cooper offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
General terms and conditions
The general terms and conditions of the online store mollyandcooper.com are compiled in accordance with the Consumer Protection Act (hereinafter: ZVPot), with the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for e-commerce.
The mollyandcooper.com online store (hereinafter referred to as “we” or “the seller” or “Molly and Cooper” or "online store") is operated by the company M & C Studio d.o.o. (hereinafter “the company” or “Molly & Cooper”).
The seller: M & C Studio d.o.o. with the business address at Ljubljanska cesta 32, 8311 Kostanjevica na Krki, Slovenia, company registration number: 8795134000 and tax number: SI 81475420 (the company is not a taxable person).
The customer has to be over 18 years of age to purchase or use products from the mollyandcooper.com online store. By confirming your agreement to the general terms and conditions below, you also confirm that you are over 18 years of age.
The company undertakes not to set any contractual terms that would be unfair to the consumer, in accordance with the provisions of ZVPot. Unfair contract terms are void.
These general terms and conditions are published on the website www.mollyandcooper.com in the ''Terms and conditions'' section in the footer of the page, they are also kept in physical form at the company's headquarters. By publishing on the website, it is considered that the Terms of service are known to the buyer, and by concluding the sales contract, the buyer declares that she/he has read the general terms and conditions and is fully acquainted with them.
Availability of information
The company undertakes to always provide the user the following information:
- company identity (company name, address, registration number),
- contact information that enables the user a quick and effective communication (e-mail, telephone),
- essential characteristics of the products,
- availability of products (each product offered on the website is available within a reasonable time)
- terms of delivery of products (method, place and deadline of delivery),
- prices that are clearly and unambiguously specified and show whether they already include taxes and transport costs,
- method of payment and delivery,
- temporal validity of the offer,
- the period within which it is possible to withdraw from the contract and conditions for withdrawal; moreover, information about potential costs of returning the product for the buyer,
- explanation of the complaint procedure, including all details of the contact person.
Use of language
In accordance with the first paragraph of Article 2 of the ZVPot, the company deals with consumers in the English and Slovenian language. It uses the full name of the company and registered office in written communications. When labeling products, it provides the customer with the necessary information regarding the characteristics, sales conditions, use and purpose of the product. This information is in the language that consumers in the area of the Republic of Slovenia can understand. Instead of verbal language, the company also uses generally understood symbols and images when labeling products.
The Molly and Cooper online store offers a choice of Slovenian and English language. It is possible to conclude a contract in both of the mentioned languages.
Type of users
By registering at mollyandcooper.com you become a member of the online store. Registered members as well as guests who make a quick purchase and do not need to register before making a purchase have the right to purchase in the online store.
Upon registration in the online store, the visitor obtains a username that is the same as his e-mail address, and a password. If a user wishes to change his e-mail address or password at any time, he can do so in his user profile.
Product offer
Products offered through the online store are part of the offer of the company M & C Studio d.o.o..
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. However the company cannot guarantee that your computer monitor's display of any color will be accurate.
Due to the nature of online shopping, the product offers in the Online Store are often and rapidly evolving and updating. As a result, errors can occur. We kindly ask you to inform us of any errors via email to info@mollyandcooper.com. We will try to correct them as soon as possible.
Prices
All prices indicated for Items at Molly & Cooper website are final and exclusive of VAT. Molly & Cooper Studio d.o.o. is not VAT registered company therefore VAT exempt under Article 138(1) of Directive 2006/112/EC.
Prices displayed on the Site are in Euros and do not include shipping fee. Please check Delivery information section for more information about shipping fees and additional charges.
Prices are valid at the time of the order and do not have a predefined validity. Occasionally prices fluctuate according to current promotions.
Prices in the online store mollyandcooper.com are the same for both registered members and guests of the online store.
The company will give the buyer the final price before concluding the contract or before the offer becomes binding for the buyer. The purchase contract between the seller and the buyer is concluded at the moment when the seller confirms the order (the buyer receives an electronic message about the status "Order confirmed"). From this moment on, all prices and other conditions are fixed and apply to both the company and the buyer.
Promo codes
The promo code brings various benefits (product discounts, free shipping etc.) when purchasing and is limited in time. An active promo code is published by the seller in a way that corresponds to the purpose of the seller's marketing campaign. The seller does not guarantee that there is an active promo code at the time of purchase.
You can find an active promo code in our advertisement, an e-mail or in other media. The code brings various benefits. Any code is always limited in time, but must be redeemed within a limited time, otherwise it is invalid.
How do I use a promo code (coupon)?
A promo code is an alphanumeric string of characters that the user enters before completing an order by entering in the "promo code" field. After that, the benefit automatically assigned to the coupon is activated in the system and it becomes clear in the product basket that the coupon has been activated.
Shipping
Molly & Cooper ships products to all European countries. The section Delivery information provides more information on delivery times and shipping costs. All orders from outside the European Union may be subject to import duties and taxes, which must be paid upon arrival of the shipment and are not included in the shipping costs. Customs costs vary from country to country and if the buyer needs detailed information on customs costs, the seller will refer him to the local customs office.
Payment methods
The online store allows the following payment methods:
- with payment or credit card (Mastercard, Visa, American Express)
- via the PayPal system
Cash on delivery via the online store is not possible.
The company ensures that the customer, in the process of placing an order when concluding a distance contract using electronic means, explicitly confirms that he agrees to the payment by placing an order. The function that triggers the order is marked with the words ''confirm order''. By confirming the order, the consumer assumes the obligation of payment to the company.
Purchase procedure
I. Product selection: On the website www.mollyandcooper.com the user selects the product and its characteristics and clicks on the "Add to cart" link. The system notifies the customer that the product has been successfully added to the cart. To continue shopping, the customer need to click the "x" on the top right and return to the online store. To complete the purchase, they must right-click on the "Checkout" link and the system will take them to the shopping cart.
II. Removing the product from the shopping cart: In the upper right corner of the website, there is a shopping cart icon, in which after clicking on the icon, the user is shown the products they added to the shopping cart while browsing the online store. The user clicks on "Remove" button for the product they want to remove from the cart. Clicking on the "Continue shopping" link returns them to the online store.
III. Shopping cart:
To complete the order, the user must complete their information and select the payment method.
In the fields, the user submits the required information (e-mail, name, surname, address, address, place, postal code and telephone number), which we need to confirm and complete the order and deliver the product. If the user has not yet applied the promo code, he can re-enter it in the upper right corner. The form allows the user's data to be saved for the next order.
The user confirms his data by clicking on the "continue" button and arrives at the page to calculate the cost of delivery.
The products that the user added to the shopping cart while browsing the online store are displayed. The price of the product, the cost of shipping, the value of VAT and the total cost of payment are shown in the shopping cart before the order is completed. If the user has a valid discount code, they enter it in the appropriate field above the payment option and clicks the "use coupon" button.
By clicking on the "continue" button, the user arrives at the page where they select the type of payment (payment by credit card or paypal) and fills in the data. He also must specify the address for issuing the invoice. The user finally confirms the order in the next steps by clicking on the "Complete order" button.
IV. Completion of the order: The user can view the provided delivery information, the chosen payment method and the contents of the shopping cart. If the order has been successfully completed, the website displays the text ''Thank you! Your order has been successfully completed.''
V. Purchase notification procedure: After placing an order, the customer receives an e-mail notification that the order has been accepted. When the package is shipped they also receive the tracking number of the package.
The online store reserves the right to call the customer on provided contact telephone number to verify the data or to ensure the accuracy of the delivery.
Order completion
The purchase contract between the seller and the buyer is concluded in the online store at the moment when the seller sends the first e-mail confirming his order. From that moment on, all prices and other conditions are fixed and apply to both the seller and the buyer.
The sales contract (i.e. the first electronic message on the status of the order) is stored in electronic form on the seller's server and is available to consumers upon their written request.
Consumer's right of withdrawal from the contract and the refund
The customer (buyer) has the right to cancel the sales contract without providing any reason. The cancellation period expires after 14 days from the day on which the customer acquires pyhsical possession of the goods. To exercise their right to cancel, the customer has to inform the Seller of the decision to cancel the contract by a clear statement (sent via letter or e-mail to support@mollyandcooper.com). To meet the cancellation deadline, it is sufficient to send the communication concering the customer's right to cancel before the cancellation period has expired.
Effects of cancellation
If the customer (buyer) cancels the contract, they will be reimbursed for any payments to the Seller, excluding the cost of delivery. The Seller might make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by the customer.
The Seller will make the reimbursement without undue delay, and not later than:
a) 14 days after the day the Seller receives the returned goods,
b) (if earlier) 14 days after the day the customer (buyer) provides evidence that they have returned the goods, or
c) if no goods were supplied, 14 days after the day the Seller is informed of the cancellation.
The Seller will make the reimbursement using the same means of payment as the initial transaction, unless agreed upon otherwise. The customer (buyer) will not incur any fees as a result of the reimbursement. The seller may withold reimbursement if they have not received the returned goods or have not received evidence that the good were sent back.
The customer (buyer) has to contact the company to support@mollyandcooper.com and then return the goods to the address: M&C Studio d.o.o., Ljubljanska cesta 32, 8311 Kostanjevica na Krki, Slovenia, not later than 14 days from the day on which the cancellation was communicated. The deadline is met if the customer (buyer) sends the goods back before the period of 14 days expires. The customer (buyer) bears the costs of returning the goods.
The products sent back to the Seller must be returned intact, in their original packaging and in unchanged quantity, except in the event that the products have been damaged, lost, expired or their quantity is not adequate and all this is not customer's fault.
The customer is liable for any diminished value of the goods resulting from handling other than what is neccessary to establish the nature, characteristics and functioning of the goods.
The customer does not have the right to withdraw from a distance contract for the delivery of sealed goods that have been unsealed after delivery and are no longer suitable for return because health or hygiene reasons.
The Seller packages all the products in the delivery box before shipping them. All the products are undamaged before packaging, carefully inspected and in their original packaging.
For returned products, the Seller will, in the shortest possible time, or within a maximum of 14 days from having received the notice of withdrawal from the customer, credit the customer with the sum paid or, in the case of purchase with a gift voucher, the gift certificate of the same value. Any discounts or promotional codes used for the purchase cannot be given to the customer in case of withdrawal. The reimbursement of the amount paid will be made by the seller on the client's current account.
Clerical errors
An error is considered clerical:
- if the product is missing an essential characteristic, necessary for its normal use,
- if the product is missing a characteristic necessary for the use that the customer is purchasing it for and that characteristic is know or should be known to the Seller,
- if the product does not have the characteristic and qualities that were explicitly or silently agreed upon or prescribed,
- if the Seller has delivered a product that does not match the sample or model, except when the sample or model was shown only for the purpose of a notice.
The customer (buyer) must inform the Seller and exactly describe the issue, no later than 2 months after discovering the error, by contacting support@mollyandcooper.com.The Seller can not be held accountable for errors that occur 2 years after the purchase of the product. The customer must enable the seller to inspect the product.
If the customer issues a complaint in the first 6 month of receiving the product, the Seller must prove that the complaint is unjustified, that is, that the product has no error. If the customer issues a complaint after 6 months, the customer must prove the existence of the error.
The customer (buyer) who correctly informed the Seller of the error has the right to demands that the Seller:
- remedies the error,
- returns part of the amount paid in proportion to the error,
- replaces the defective goods with new products,
- returns the amount paid.
The customer (buyer) can decide which of these to claim and the claims are not bound to any order in which they should be claimed.
If the existence of the error is not disputable, the Seller must comply with the user’s request as soon as possible and no later than within 8 days.
The seller must reply to the customer (buyer) in writing upon request no later than 8 days after receiving the request, if the existence of a defect is disputable.
Security
Molly & Cooper uses appropriate technological and organizational means to protect the transmission and storage of personal data, orders and payments. Credit card authorizations are performed in real time with immediate verification of data at banks. Card information is not stored on the server.
Personal data information
The seller undertakes to permanently protect all personal data of the user.
The seller keeps the IP addresses of all visitors to the Molly & Cooper online store for an indefinite period of time, and for customers also: name and surname, e-mail address, contact telephone, primary address and delivery addresses, country of residence, gender, time and date of purchase and an archive of communication with the seller.
The seller will use personal data exclusively for the purpose of fulfilling the order (sending information material, offers, invoices) and other necessary communication. In no case shall the user's data be handed over to unauthorized persons.
The user is responsible for the protection of personal data by ensuring the security of his username and password and adequate software (antivirus) protection of his computer.

Legal notice
The online store and all the information on it, product images, graphic and video elements on the website are protected by the Copyright Act and may not be reproduced or used without prior written permission.
Limitation of liability
The seller does his best to ensure that the information published on the website is up-to-date and correct. However, product features, delivery time, or price may change so quickly that the online store sometimes fails to correct the information on the website. In this case, the seller will inform the buyer of the changes and allow him to cancel the order or to change the ordered goods.
Exclusion of liability
The seller reserves the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or hindering the use of the online store. In case of technical problems on the website, we reserve the right to cancel placed orders that have been affected by a technical error. In the event of order cancellation, we will notify you as soon as possible and inform you of the next steps. The customer must ensure that the equipment (antivirus, etc.) is adequately protected against accessing and using the website and also ensure the appropriate security and confidentiality of the data used to log in to the website (e-mail address, password).
Complaints and disputes
The Seller follows the applicable consumer protection regulations. The Seller has an effective customer support system for resolving complaints and employs a person that can be contacted by customer (buyer) via e-mail in case any issues occur. In case of issues or a wish to appeal the customer (buyer) can contact the Seller via the email address support@mollyanccooper.com. The complaint processing procedure is confidential.
The Seller will confirm that the complaint has been received within five working days and the guarantee claim will be resolved within the statutory deadline. The Seller will strive to resolve any dispute under mutually agreed conditions. If a mutually agreed upon solution can not be reached, all disputes between the seller and user (customer) will fall under the jurisdiction of the appropriate court.
These general terms and conditions of service and all disputes between the Seller and customer (buyer) fall under the jurisdiction of Slovenian law.
For all rights and obligations not specified under these terms and conditions, provisions of the Code of Obligations, the Electronic Commerce Act, the Data Protection Act and the Consumer Protection Act shall apply.
Out-of-court Dispute Resolution
In accordance with legal norms, Molly & Cooper does not recognize the authority of any out-of-court provider for settling disputes, launched by the customer (buyer) by the Out-of-Court Consumer Dispute Resolution Act.
In the event that the customer (buyer) is not satisfied with the resolution of the complaint, they can, in accordance with Out-of-Court Consumer Dispute Resolution Act, file to initiate the procedure of out-of-court settlement of a specific consumer dispute through the European Commission for Online Dispute Resolution. The customer (buyer) can also decide to file a lawsuit with the competent court according to the customer (buyer) permanent address.
Governing law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Slovenia.
Changes to terms and conditions
You can review the most current version of the Terms of Service at any time at this page.
The seller reserves the right, at its sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to Molly & Cooper website. The general terms and conditions are binding in that form and with regard to the content that was available to the parties on the day of concluding the contract. In the event of a change in the general terms and conditions, the changes become binding for the customer from the day they become acquainted with them.
The seller will notify users of these changes in an appropriate way. Any changes and/or amendments to the terms and conditions enter into effect after a period of 8 days from the publication of changes and/or amendments. If the changes and/or amendments are necessary in order to comply with regulations, they may exceptionally enter into effect earlier than that.
Any user who does not agree with the changes and/or amendments to the general terms and conditions has to, within 8 days of being notified of the changes, revoke his registration. If the user does not revoke his registration it will be considered that the user accepts the changes and/or amendments and no evidence to the contrary will be admissible. The registration can be cancelled with a written declaration to the seller.
